Do Kwon Requests US Judge to Reschedule SEC Trial Due to Extradition Delays
Do Kwon, founder of Terraform Labs, reportedly requested a court postpone the trial before the United States Securities and Exchange Commission (SEC) until March so that he could attend.
According to previous reports from Inner City Press, Kwon’s legal team has recently asked District Judge Jed S. Rakoff to postpone the trial in order to facilitate the extradition of their client, who is currently in detention by Montenegrin authorities.
The letter from Kwon’s attorneys states that if the court denies his request, he would want the jury to be told the reasons he couldn’t testify.
“Mr. Kwon would want to be present at his trial. Legal representation had anticipated a quicker resolution to the extradition process in Montenegro. It seems that extraditing Mr. Kwon will not happen until February or March, which is rather unfortunate. We acknowledge that the Court cannot perpetually postpone the trial; nevertheless, extending the delay until about the middle of March would provide Mr. Kwon with a reasonable opportunity to be present.
Because of these reasons, Mr. Kwon is requesting a brief postponement of the trial date so that he may attend. He has not waived his right to do so. In the event that the court decides not to postpone the trial, Mr. Kwon plans to request that the court provide the jury with an instruction that does not unfairly disadvantage him because of his absence and incapacity to testify.”
Last year, Kwon tried to go on a plane to Dubai using fake IDs, and he was caught in Montenegro for it. The US and South Korean governments are looking for him on suspicion that he contributed to the multi-billion-dollar collapse of the Terra (LUNA) ecosystem in 2022.
